EU Court to Hear New Complaint Against Spain Over State Compensation Rules

Brussels is gearing up to take Spain back to the EU’s top court over how the country handles claims for state‑caused damage.

  1. In June 2022 the European Court of Justice ruled that Spanish law makes it overly hard for individuals to obtain compensation when the state breaches EU rules.
  2. Spain failed to amend its legislation despite the judgment, leaving a gap between national rules and EU obligations.
  3. This Thursday the European Commission announced it will file a fresh infringement case, urging the Court of Justice of the EU to enforce compliance.

Spain now faces another round of legal pressure to simplify compensation claims.
