Spain’s Supreme Court to Review Tax Deductions for Non-EU Property Owners

Spain’s Supreme Court will determine if property owners residing outside the European Union can deduct rental expenses from their taxes. The court’s Administrative Chamber accepted an appeal filed by the State Attorney’s Office regarding this fiscal practice.

  1. The National Court previously ruled in July 2023 that a non-EU resident had the right to deduct rental-related costs.
  2. That lower court decision argued that denying these deductions created discrimination compared to EU or European Economic Area residents.
  3. The Supreme Court must now decide if current Spanish tax treatment violates the principle of free movement of capital under European law.

This case marks the first time the high court has addressed the tax disparity for non-EU property owners. #Spain #TaxLaw #SupremeCourt #RealEstate
